Overview

Technology is ubiquitous. It is the infrastructure of our daily lives but also gives rise to many weighty legal issues. Particularly in intellectual property (IP) law, where tension between rewarding intellectual development and incentivising further developments, is most acute in the context of technological advancement. With other issues concerning digital assets and IP, the legal sector finds itself in a new web of regulating, promoting and guiding the public in the future of such disputes.

This module delves into IP laws and applying it to digital assets. Participants will acquire the knowledge to making proper considerations in managing and disputing IP matters. They will also learn how to manage digital assets and understand the application of IP law in this digital age.

Learning Objectives

At the end of the 2-day module, participants will be able to:

  • Understand the concepts of inventorship, authorship and ownership as applied to digital assets and new technologies; new characterisations
  • Demonstrate specialised knowledge of technology transfer agreements
  • Understand the anatomy of IP disputes – pre-action stage to Court of Appeal proceedings before IPOS
  • Analyse key considerations when undertaking settlement discussions
  • Understand IP wars - the international stage (US versus China)
  • Understand case studies in the field of trademark infringement, passing off, copyright, patents and breach of confidence
  • Understand digital assets and what they comprise
  • Understand intellectual property (IP) laws and how they apply to digital assets
  • Understand recent and proposed IP reforms
  • Analyse the pros and cons of alternative dispute resolution fora for IP matters (arbitration, mediation, the Singapore International Commercial Court)
  • Appreciate the management and monetisation of digital assets
  • Understand the strategic considerations and outcomes that drive decisions in managing IP disputes

Assessment

As part of the requirement for SkillsFuture Singapore, there will be an assessment conducted at the end of the course. The mode of assessment, which is up to the trainer’s discretion, may be an online quiz, a presentation or based on classroom exercises.

Participants are required to attain a minimum of 75% attendance and pass the associated assessment in order to receive a digital Certificate of Completion issued by Singapore Management University.


CPD POINTS

Participants will be able to earn 12 CPD Points awarded by Singapore Institute of Legal Education when they attend this course.

Participants who wish to obtain CPD Points are reminded that they must comply strictly with the Attendance Policy set out in the CPD Guidelines. For this activity, this includes signing in on arrival and signing out at the conclusion of the activity in the manner required by the organiser, and not being absent from the entire activity for more than 15 minutes. Enhanced Training Support for SMEs (ETSS)

  • Organisation must be registered or incorporated in Singapore
  • Employment size of not more than 200 or with annual sales turnover of not more than $100 million
  • Trainees must be hired in accordance with the Employment Act and fully sponsored by their employers for the course
  • Trainees must be Singapore Citizens or Singapore Permanent Residents
  • Trainees must not be a full-time national serviceman

Dr Lai, Partner & Head of Intellectual Property Practice at Allen & Gledhill LLP, specialises in IP litigation, IT disputes, and commercial litigation. He advises on IP/ data management, cybersecurity, and healthcare and medical IP issues. Dr Lai is also recognised in Chambers Asia-Pacific and The Legal 500 Asia Pacific. He chairs the Intellectual Property Office of Singapore and serves on the Singapore International Arbitration Centre IP Panel and Singapore Copyright Tribunal. Additionally, he's a Principal Mediator at the Singapore Mediation Centre. Dr Lai has authored works on IP and IT law, including "The Copyright Protection of Computer Software in the United Kingdom" and "Publisher reigned in on racing data copyright claim".
