Overview
With increased digital collaboration and the use of digital tools, what are the potential legal issues that may arise? For example, how should employers determine what acts constitute cyber-bullying or cyber-harassment and hence misconduct? Can employers use remote surveillance in their due inquiry? With employees becoming more educated about their rights and the landscape potentially becoming more litigious, employers must relook their compliance processes with fresh lens.
Learning Objectives
At the end of the two-day module, participants will be able to:
- Appreciate, identify and navigate key employer obligations relating to Employee Exit issues and understand their application in the Digital Age.
- Understand how the employment landscape has evolved and how it has affected employee-employer conflicts and the available mechanisms for Employee Dispute Resolution.
- Managing risks of wrongful dismissals or constructive dismissals through proper performance improvement plans, due inquiries, re-employment plans, and grievance handling.
Topic/Structure
Day 1:
- Legal obligations and pitfalls at the Employee Termination stage including conducting an “at-will” termination, or a termination based on poor performance, misconduct or redundancy and retirements, as well as resignations.
- Managing risks of wrongful dismissals or constructive dismissals.
- How digitalisation affects and impacts the above legal issues in Employment Termination, including managing garden leave, suspensions, due inquiry requirements, termination notices, as well as conduct matters such as cyber-bullying, cyber-harassment, social media use, confidentiality and remote surveillance.
Day 2:
- The evolution and escalation of employer-employee conflicts; and practical steps to take to avoid, mitigate and manage them; how digitalisation intersects and impacts legal issues with respect to Employee Dispute Resolution such as e-accessibility to company rules, e-paper trails to evidence misconduct.
- The role and function of unions, Tripartite Alliance for Dispute Management (TADM), Employment Claims Tribunal and the courts in Singapore in resolving employee disputes.
- TAFEP's role, watchlist, observations on non-compliance trends, enforcement priorities, and advice for employers (during recruitment, managing or termination stages).
Leveraging on SMU’s distinctive pedagogy for interactive, discussion driven and thought provoking seminar-style teaching, we aim to provide our participants with the ability to translate the learning and insights into practice at the workplace. A variety of teaching methods such as experiential learning, role plays, case discussions, presentations, exercises and oral questioning will be employed by the programme’s faculty in the training sessions. There will also be an individual assessment at the end of every module which serve to assess a participant’s understanding of the subject matter.
Assessment
Participants have to meet a minimum attendance rate of 75% and have to complete all assessment(s) required by the course. Only upon meeting the minimum attendance and passing the assessment will participants be issued a Certificate of Completion.
Participants who fail the assessment will be given a chance for re-assessment at a fee of SGD100.00 (excluding prevailing GST). Each participant is allowed 1 re-assessment. The re-assessment has to be taken within 7 calendar days from the end of the course date. It will be held on a weekday specified by SMU Academy and conducted during office hours. Please note that re-assessment fees are not supported by SSG Funding.
Participants who meet the minimum attendance rate but do not achieve a pass for the assessment will be issued a Certificate of Participation.
Participants are required to bring their laptop to access the course materials, class exercises and individual assessment(s).
