Overview
As digitalisation continues to shape the workplace – from remote working capabilities, surveillance tools, to algorithmic decision-making etc. – what are the potential legal issues that may arise for employers with respect to the Recruitment and Management aspects of Employment Law? How should employers consider other digitalisation-related issues, such as employees’ social media usage or data privacy etc?
Through interactive discussions, real-world examples and case studies, participants will learn how they can navigate the risks and pitfalls and ensure legal compliance in the modern workplace.
Learning Objectives
At the end of the two-day module, participants will be able to:
- Identify the sources of Singapore employment law, regulations and policies.
- Appreciate, identify and navigate key employer obligations relating to Employee Recruitment and Management matters and understand their applications in the Digital Age.
- Understand key legal issues and risks relating to Employee Recruitment and Management matters; and the practical dos and don’ts.
Topic/Structure
Day 1:
- An introduction to the Singapore legal system from the employment perspective, including the stakeholders, sources of employment law and policy, and employee categories under the Employment Act 1968, such as who is an “employee”.
- Legal obligations and pitfalls at the Employee Recruitment stage including advertising, shortlisting, and contracting; and the impact of workplace fairness laws on these.
- How digitalisation intersects and impacts the above legal issues in Employee Recruitment, including algorithmic selections, remote interviews, privacy and immigration/compensation-related issues due to cross-border remote working.
Day 2:
- Legal obligations and pitfalls at the Employee Management stage including the handling of compensation and benefits, learning and development, performance management, employee conduct, diversity & inclusion initiatives, flexible work arrangements and workplace safety and health; and the impact of workplace fairness laws on these.
- How digitalisation intersects and impacts the above legal issues in Employee Management, including algorithmic selections, remote surveillance, privacy, social media use, confidentiality in digital settings and performance management-, conduct- and workplace safety-related issues in remote working.
Leveraging on SMU’s distinctive pedagogy for interactive, discussion driven and thought provoking seminar-style teaching, we aim to provide our participants with the ability to translate the learning and insights into practice at the workplace. A variety of teaching methods such as experiential learning, role plays, case discussions, presentations, exercises and oral questioning will be employed by the programme’s faculty in the training sessions. There will also be an individual assessment at the end of every module which serve to assess a participant’s understanding of the subject matter.
Assessment
Participants have to meet a minimum attendance rate of 75% and have to complete all assessment(s) required by the course. Only upon meeting the minimum attendance and passing the assessment will participants be issued a Certificate of Completion.
Participants who fail the assessment will be given a chance for re-assessment at a fee of SGD100.00 (excluding prevailing GST). Each participant is allowed 1 re-assessment. The re-assessment has to be taken within 7 calendar days from the end of the course date. It will be held on a weekday specified by SMU Academy and conducted during office hours. Please note that re-assessment fees are not supported by SSG Funding.
Participants who meet the minimum attendance rate but do not achieve a pass for the assessment will be issued a Certificate of Participation.
Participants are required to bring their laptop to access the course materials, class exercises and individual assessment(s).
