PREREQUISITES

Participants should preferably be a degree holder, in any discipline, and have at least one year of working experience.

Overview

This module provides participants with knowledge on the different modes of winding up, and with a particular focus on court-ordered winding up. The course will explore how a company can be placed in liquidation and the effects of a liquidation, legal implications on the stakeholders, the roles and powers of liquidators, and the practical and commercial issues to consider over the course of the liquidation administration. A section of the module will also cover another form of recovery, mainly for secured creditors which is receivership and its relationship with the liquidation process. Participants will also learn the basics of personal bankruptcy and the administrative process to exit bankruptcy through a discharge and/or an annulment.

Learning Objectives

At the end of the module, participants will be able to:

  • Gain competency on the different types of insolvency regimes in Singapore
  • Be familiar with the powers and duties of liquidators and the practical aspects of managing a winding up, especially in the context of a Court-Ordered Winding Up
  • Gain basic knowledge and understanding of receivership and bankruptcy administration in Singapore

Assessment

As part of the requirement for SkillsFuture Singapore, there will be an assessment conducted at the end of the course. The mode of assessment, which is up to the trainer’s discretion, may be an online quiz, a presentation or based on classroom exercises.

Participants are required to attain a minimum of 75% attendance and pass the associated assessment in order to receive a digital Certificate of Completion issued by Singapore Management University.

 

CPD POINTS

Participants will be able to earn 6 CPD Points awarded by Singapore Institute of Legal Education for this course.

Participants who wish to obtain CPD Points are reminded that they must comply strictly with the Attendance Policy set out in the CPD Guidelines. For this activity, this includes signing in on arrival and signing out at the conclusion of the activity in the manner required by the organiser, and not being absent from the entire activity for more than 15 minutes. Gary is an experienced insolvency practitioner at RSM and the Deputy Industry Lead for the Real Estate & Construction Practice. He has a strong track record in managing complex insolvency and restructuring assignments, including liquidation, receivership, judicial management, schemes of arrangement, turnaround consulting, and private trustee in bankruptcy appointments. At RSM, Gary has led several successful schemes of arrangement, enabling company turnarounds and recovery.

Before joining RSM in 2018, Gary worked for over a decade in the restructuring division of a Big 4 accounting firm. He has advised public-listed companies and SMEs across diverse sectors such as construction, shipping, financial services, oil and gas, retail, legal services, food and beverage, and manufacturing.

Gary is a founding executive committee member and co-chairperson of the Young Insolvency Practitioners’ Committee of the Insolvency Practitioners Association of Singapore (IPAS). Y C Chee (“YC”), an executive director of RSM SG Corporate Advisory Pte Ltd, is a public accountant and senior partner of RSM Singapore.  YC is also a licensed Insolvency Practitioner.  He possesses more that 35 years of experience in insolvency related and forensic accounting services.

In year 2016 when the Bankruptcy (Amendment) Act 2015 came into effect, YC started the Private Trustees in Bankruptcy (“PTIB”) Services and currently jointly leads a team of more than 20 staff specialising in the PTIB services.

Outside professional work, YC is a member of the Boad or Directors of Insolvency Practitioners Association of Singapore Limited (“IPAS”) and is actively involved in education and training.
